Terms of Service
The agreement between you and Verbatim, in plain language.

Verbatim (“Verbatim”, “we”, “us”) is a video hosting and transcription service operated by Ben Gladwell. These terms apply when you create an account or use the service at app.verbatim.video. If you do not agree with them, do not use Verbatim.
Your account
You need an account to upload or watch videos. You must give a working email address and confirm it before signing in. You are responsible for what happens under your account, including keeping your password to yourself. Tell us at support@verbatim.video if you think someone else has access to it.
You must be at least 18 years old to upload or publish a video or make a purchase. If you are between 13 and 17, you may create an account only to watch videos shared with you and only with the permission of your parent or legal guardian. Children under 13 may not create or use a Verbatim account.
What you are buying
Verbatim sells a one-time publication of a single video. There is no subscription and no recurring charge. When you complete a purchase for a video:
- The video is published and remains available without any further payment.
- The tier you chose sets the maximum video length, the maximum number of people you may share it with, and the amount of included delivery.
- Payment applies to that video only. Publishing another video is a separate purchase.
Prices are in US dollars and are shown before you pay. Payment is processed by Stripe; we do not receive or store your card details. You are responsible for any taxes that apply to you.
You may upgrade a video to a higher tier. When you do, you pay the difference between the tier you already hold and the new one, except that upgrading from the free tier charges the full price of the paid tier.
The free tier
Each account may publish one video on the free tier. Free videos play the first 10 minutes, are transcribed for that window, and may be shared with one person. You may upgrade a free video to a paid tier at any time, which restores the full video. We may change or withdraw the free tier for new videos, but doing so will not affect a video you have already published.
Included delivery
Each tier includes an amount of delivery — the total volume of video data we will serve for that video over its lifetime. If a video exceeds its included delivery, we may make it temporarily unavailable rather than charge you more. If a higher tier is available, upgrading raises the allowance and restores availability. If there is no higher tier, email support@verbatim.video and we will talk through the options. We will never bill you for overage without your agreement.
Delivery is measured from our content delivery network’s logs and is not real-time. A video may therefore go somewhat beyond its included delivery before it becomes unavailable, but we will not charge you for that additional delivery.
How long we host your video
We host published videos for the life of the service. There is no expiry date on a published video, and we will not remove a video because a payment stopped — there is no recurring payment.
If we ever have to discontinue Verbatim, we will give you reasonable advance notice and a reasonable period to retrieve your videos before shutting anything down. We nonetheless recommend that you keep your own copy of anything irreplaceable. Verbatim is a publishing and sharing service, not a backup service.
Your content
Your videos remain yours. We claim no ownership of anything you upload.
You grant us the limited licence we need to run the service: to store, encode, transcribe, index, and deliver your video to the people you share it with. That licence exists only to operate Verbatim, ends when you delete the content, and does not let us use your videos for anything else — we do not use your content to train models, we do not show it to anyone you did not share it with, and we do not sell or licence it to anyone.
You promise that you have the rights to everything you upload, including the rights of anyone appearing or speaking in it, and that sharing it through Verbatim does not break any law or any agreement you are party to.
Verbatim itself — including its software, design, name, and branding — belongs to Ben Gladwell, apart from open-source components and anything owned by someone else. We give you a limited, personal permission to use the service under these terms. You may not copy, resell, or reverse engineer the service except where the law permits it.
Copyright complaints
If you believe that something stored on Verbatim infringes your copyright, email a written notice to support@verbatim.video that includes:
- your physical or electronic signature
- identification of the copyrighted work
- identification of the material you want removed and enough information for us to find it
- your name, address, telephone number, and email address
- a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for the owner
We will respond promptly to a complete notice by removing or disabling access to the material and notifying the person who uploaded it.
If your material was removed because of a copyright complaint and you believe that was a mistake, you may send a counter-notice to the same address. It must include:
- your physical or electronic signature
- identification of the removed material and where it appeared before removal
- a statement under penalty of perjury that you believe in good faith that the material was removed because of a mistake or misidentification
- your name, address, and telephone number
- a statement that you consent to the jurisdiction of the appropriate United States federal district court and will accept service of process from the person who submitted the complaint
We will send a complete counter-notice to the person who submitted the complaint. We will restore the material between 10 and 14 business days later unless that person tells us that they have filed a court action seeking to keep it offline.
We may close the accounts of people who repeatedly infringe copyrights. Knowingly making a false claim of infringement or a false counter-notice may make you liable for resulting damages.
Acceptable use
Do not use Verbatim to store or share:
- content you do not have the rights to
- pornographic or sexually explicit content of any kind
- child sexual abuse material or any other content that sexually exploits or endangers a minor
- any other content that is illegal where you or we operate
- content that harasses, threatens, or promotes violence against people
- malware, or material intended to compromise other people’s systems
Do not attempt to circumvent tier limits, access videos that were not shared with you, disrupt the service, or scrape it in bulk.
We may remove content or suspend an account that breaks these rules. Where the breach is not serious and not deliberate, we will contact you first.
Transcripts
Transcripts are generated automatically by a third-party speech recognition service and are not checked by a person. They will contain errors, particularly on difficult audio. They are provided as a way to navigate and search your video, and are not certified, verbatim, or suitable as a legal record. We make no warranty about their accuracy.
Refunds
If Verbatim does not process, transcribe, publish, or play your video as described, email support@verbatim.video within 30 days of purchase. We will try to put it right. If we cannot, we will refund what you paid for that video.
We do not offer refunds simply because you change your mind after publishing a video. Deleting a video does not automatically refund its purchase.
Nothing here limits any refund or other remedy required by law.
Deleting and terminating
You may delete a video at any time. Deleting removes the video, its transcript, and the underlying files, and it cannot be undone.
You may close your account from your account settings or by contacting us. Closing your account permanently deletes the videos you own, their transcripts, and their underlying files. It also ends your access to videos other people shared with you. Closing an account cannot be undone and does not automatically refund any purchase.
We may suspend or close an account that breaks these terms. Unless we need to act immediately to protect someone, protect the service, or comply with the law, we will contact you first and give you a reasonable opportunity to retrieve your videos.
Availability and disclaimers
We work to keep Verbatim available, but we do not guarantee uninterrupted or error-free service. Verbatim is provided “as is” and, to the fullest extent the law allows, without warranties of any kind.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive losses arising from your use of Verbatim. Our total liability for any claim is limited to the greater of $100 or the amount you paid for the video or videos the claim concerns.
Nothing here limits liability for fraud, gross negligence, intentional misconduct, or anything else that cannot legally be limited.
If your use causes a claim
If your content or your use of Verbatim causes a claim against us because you broke these terms, violated the law, or infringed someone else’s rights, you agree to cover the reasonable losses and legal costs that result. You do not have to cover a claim caused by our own negligence or misconduct. We will notify you promptly and give you a reasonable opportunity to participate in the defence.
Things outside our control
We are not responsible for a delay or failure caused by events reasonably outside our control, such as a widespread network or cloud-provider outage, natural disaster, war, government action, or labour dispute. This does not excuse obligations that can still reasonably be performed.
Changes
We may make minor corrections or clarifications to these terms by posting the updated text and changing the date at the top. If a change materially affects your rights or obligations, we will email account holders before it takes effect and, where appropriate, ask you to accept the updated terms when you next use Verbatim.
Changes apply going forward. They will never retroactively remove a hosting commitment for a video you have already published.
A few legal details
These terms, together with any policies they expressly refer to, are the complete agreement between you and Verbatim about the service. They replace any earlier agreement about the same subject.
If a court finds that one part of these terms cannot be enforced, the rest will remain in effect. If we do not enforce a provision once, that does not waive our right to enforce it later.
You may not transfer your account or your rights under these terms without our permission. We may transfer these terms as part of incorporating Verbatim or transferring the service to a new owner, provided that the successor honours the commitments made to you here.
Governing law
These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any lawsuit arising from these terms or your use of Verbatim must be brought in the state courts located in Franklin County, Ohio, or, if federal jurisdiction exists, in the United States District Court for the Southern District of Ohio, Eastern Division. You and Verbatim consent to personal jurisdiction and venue in those courts.
